I am not a lawyer, but the labor laws

The labor laws don't say anything that an employed
person must be "running things" -

If you have been long enough in Japan, maybe you remember
the privatization of JNR. Suddenly, after JNR was privatized
some of the employees were selling apples and potatoes in the
stations - maybe these were the people "running things" before
at JNR.
